Can open source technology be patented?
Yes, open-source software can and should be patented. Open-source software (OSS) patents may sound like an oxymoron. However, top open-source contributors like Google and Microsoft are also top patent holders.
Can open source software infringe patents?
A developer who has patented their open source code may technically maintain a reserved right to sue downstream users of the OSS on patent infringement. The relationship between patents, software, and open source code is not settled.

An expired patent no longer affords the inventor or patent owner any protection. When the patent expires, the concept becomes available for any organization or individual to freely use, redesign, and market without the original patent owner’s permission.

As per the Indian Patents Act, a patent is granted on a product, process or an invention for a limited period of 20 years. Hence, the life span for a patent in India is 20 years from the date of filing the patent application. You cannot extend the life of the patent.

Can a patent be filed on open source software?
According to the GPL, any modification to the original source code of the Open Source software counts as derivative work. If you release software using the GPL or other form of Open Source licensing, you are not prohibited from applying for patent protection.
Where can I find a list of patents that have expired?
However, the USPTO has established this enormous database of innovation—surely at least some of it is useful technology that has fallen into the public domain. To search for patents that have expired one can set a T-20 year period at the USPTO search or Google Patents.
